Supreme Court Watch–Obama’s Birth Certificate Case Review
UPDATE 4:00 12/5/2008: From the Swamp, it was reported that, of the two cases announced by the Supreme Court today for certain review, the Donofrio case wasn’t included. The Swamp goes on to report that according to a knowledgeable source of theirs…
“a lack of an announcement doesn’t mean the court definitely won’t hear Donofrio.”
So let’s stay tuned!
ORIGINAL POST 12/5/2008:
Today’s the day and the MSM has been characteristically tight-lipped about this case.
First mention of the day per our review goes to the LA Times which reports, with tongue-in-cheek, (excerpt)…
It may come as something of a shock to those millions planning trips to Washington for the Jan. 20 inauguration of President-elect Barack Obama that he isn’t really legally capable of taking the oath.
It’s the birth certificate thing.
That’s because he was born in Kenya to an alien father and isn’t a natural-born American as the Constitution requires and the copy of his Hawaii birth certificate looks fake to many and the state won’t release the original, which makes everything that much more suspicious.
Stay tuned…

As of 2:30 pm, there has been no news.

I’m saving this link to read later. From the excerpt you posted, Williams’ position is for the Court to be strict constructionists-originalists, as Levin would say. Unfortunately, too few judges see the constitution as the framers intended it to be, and too many are judicial activists, imposing their own political views on case law decisions.
Ironically, judges who have dismissed birth certificate cases have applied the standing requirements in a strict manner.

This is the most thoughtful and coherent comment I have read on this issue. I wish I had written this comment. This writer goes to he heart of the issue and does it in a very unbiased way.
